By accessing or using AI Newsletter ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

AI Newsletter is a SaaS platform that enables users to generate AI-powered newsletters from RSS feeds. The Service includes:

RSS feed management and aggregation
AI-powered newsletter generation using OpenAI
Newsletter history and storage (Pro plan)
Customization and personalization features

Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use
Be responsible for all activities under your account
Not share your account with others

Subscription Plans and Billing

Available Plans

Free Plan: Limited to 3 RSS feeds and 3 newsletters
Starter Plan: ₹499/month - Up to 5 feeds, 30 newsletters/month
Pro Plan: ₹999/month - Unlimited feeds, unlimited newsletters, history access

Payment Terms

Subscriptions are billed monthly in advance
Payments are processed through Razorpay
All fees are in Indian Rupees (INR) and non-refundable
You can cancel your subscription at any time
Cancellations take effect at the end of the current billing period

Acceptable Use

You agree NOT to:

Use the Service for any illegal purposes
Violate any laws or regulations
Infringe on intellectual property rights
Transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to the Service
Interfere with or disrupt the Service
Use automated systems (bots, scrapers) without permission
Resell or redistribute the Service
Generate spam or malicious content

Content and Intellectual Property

Your Content

You retain all rights to the newsletters you generate and the RSS feeds you provide. By using the Service, you grant us a limited license to process and store your content solely for the purpose of providing the Service.

Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by AI Newsletter and is protected by international copyright, trademark, and other intellectual property laws.

AI-Generated Content

Our Service uses AI (OpenAI) to generate newsletter content. You acknowledge that:

AI-generated content may not always be accurate or complete
You are responsible for reviewing and verifying generated content
We do not guarantee the quality or suitability of AI-generated content
You should not rely solely on AI-generated content for critical decisions

Usage Limits

Each plan has specific usage limits. Exceeding these limits may result in:

Temporary suspension of service
Request to upgrade to a higher plan
Additional charges for overage (if applicable)

Service Availability

We strive to provide reliable service but do not guarantee:

Uninterrupted or error-free operation
That defects will be corrected immediately
Availability at all times

We reserve the right to modify or discontinue the Service with or without notice.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

Violation of these Terms
Fraudulent or illegal activity
Non-payment of fees
Request from law enforcement

Upon termination, your right to use the Service will immediately cease.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI NEWSLETTER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Indemnification

You agree to indemnify and hold harmless AI Newsletter and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after changes constitute acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
